Meeting called to order at 4:15 P.M. under the Massachusetts Wetlands Protection Act and the Wellfleet Environmental Protection Bylaw by Chair Ed Reynolds.

Business Meeting:

·       Certificates of Compliance:
SE77-228  Samosett Avenue.  Seawall construction.  The Order of Conditions date back to 1985; construction completed and revegetated with beach grass.  Cyndi Moe Moved for approval of Certificate of Compliance; Seconded by Ginie Page; Passed 4-0.

·       Other Business:

Dottie Dolan stated it is our turn for beach clean up.  Cyndi Moe, George Moe and Dottie Dolan will go on February 14, weather permitting.

Emily Beebe reported Amy Dougherty, a geologist with the NPS is under contract with the Harbor Master’s office to conduct a sediment study of the harbor, specifically looking at grain size and transport patterns.   The study will be paid for by the marine enterprise fund as it will address future dredging issues.  

Dottie Dolan stated the Open Space Landbank Committee will be printing trail guides for Fox Island Marsh (off Pilgrim’s Way), Box Turtle Woods (off Lt. Island Road), Bayberry Hills, and Head of Mayo Creek off Old Chequesset Road.   The next Open Space Landbank Committee will meet on March 10 at 4:00 pm.

Paul Banner suggested we write the National Seashore requesting them to develop walking trail maps for the Park.   The Board feels there is a need for the public to be aware of trails in the seashore.  Paul Banner Moved to send a letter to the park; Seconded by Ginie Page, Passed 4-0.
Emily Beebe and Chris Bates to draft letter to Mark Adams of the National Seashore.

Dottie Dolan and Cyndi will attend the MACC conference.

Helen Miranda Wilson expressed concern to Dottie about a drain not working properly at Chequesset Neck Road  and Summit Street.  Emily to talk to DPW to have them check the storm drain.

The Herring River meeting scheduled for February 9 will be well attended.  Americorps is supplying notebooks for everyone.   

Public Hearings
Meeting called to order at 5:03 pm
5:04    Jones, NOI, 100 Aunt Sarah’s Way, Map 42, Parcel 59:  Single Story addition (Cont’d from 1/7/04).  DEP assigned number SE77-1019, NHESP stated no adverse impact.   Mr. Jones stated he planned on installing gutters on the eves of the roof and will have a dumpster on site for debris.  There will be no change in the existing deck configuration.  Dottie Dolan Moved to approve the Jones NOI; Seconded by Ginie Page, Passed 4-0.  Supervisor for this project is Cyndi Moe.

5:10    Glucksman, RDA, 165 Commercial Street, Map 21, Parcel 118:  Foundation Repairs.  Mr. Glucksman stated the plan calls for lowering the cellar floor and adding a four (4) inch concrete base, plus replacing windows.     It was determined this is a Negative 3.  Ginie Page Moved to approve the RDA, Seconded by Ginie Page, Passed 4-0.

5:23    Dorr, RDA, 810 Chequesset Neck Road, Map 19, Parcel 8:  Septic System Upgrade.  After reviewing the plans, it was determined this is a Negative 3.  Dottie Dolan Moved to approve the RDA, Seconded by Ginie Page, Passed 4-0.

5:30    Martin and Hoffman, AOOC, 133 Paine Hollow Road, Map 29, Parcel 399.   A site visit was made this morning.  The project, consisting of a new deck and stone patio, was previously approved.  Emily read the previous conditions and the Commission agreed to change the dates of the plan of record  with no new conditions.  Paul Banner Moved to approve the Amendment; Seconded by Ginie Page, Passed 4-0.  Supervisors will be Ginie Page, Emily Beebe and Erik Mitchell.

5:35    Menegay Trust, NOI, 190 Blue Heron Road, Map 41, Parcel 9:   Construction of Single Family dwelling.  NHESP states no adverse impact.   DEP assigned SE77-1024.David LaJoie represented the petitioners.  The Commission reviewed the prints, noting the slopes, elevations, and resource areas.  The proposed house will have a footprint of 2,016 square feet and the total disturbed area in the buffer zone exceeds 10,000 square feet.   The back of the house is within the 50 foot buffer.  Mr. LaJoie stated the house would have roof, gutter drywells, and proposes to revegetate with native grasses.  Emily Beebe stated the Commission would require Felco to flag any trees that would be cut down as a dense pine forest currently exists.    Emily stated requests for variances are heard on a case by case basis and must be presented in writing.  Dottie Dolan Moved to continue to March 3, 2004; Seconded by Ginie Page; Passed 4-0.  

6:04    Renee Back, NOI, 170 Blue Heron Road, Map 41, Parcel 9:  Construction of Single Family Dwelling.   David LaJoie represented Renee Back.  NHESP states no adverse impact.  DEP assigned SE77-1023.  The house will have a footprint of 2,300 square feet, including the deck.  Emily stated the deck and garage are barely located within the 100 foot buffer zone and it appears that the project can be achieved without locating the structure in the Buffer Zone.  The Commission asked for a landscape plan, noting which trees would be cut down, and asked Felco to investigate if the house could be moved forward in order to get out of the buffer zone.  Paul Banner Moved to continue to March 3, 2004; Seconded by Ginie Page, Passed 4-0.

6:15    Carl Back, NOI, 375 Blue Heron Road, Map 41, Parcel 114:  Construction of Single Family Dwelling.  David LaJoie represented Carl Back.  The Commissioner’s agreed this is outside of the buffer zone, that there is no coastal bank, and that this property and project did not need to come before the Commission.  An abutter of many years noted fill had been placed on the property several years ago and questioned what it was.  Another abutter stated it was sand fill, and no debris.  Another abutter questioned the location of the sewage system.  Emily Beebe stated it meets code.  Ginie Page Moved that it was not necessary to have this come before the Commissioners, Seconded by Dottie Dolan, Passed 4-0.

6:26    Donald, AOOC, 66 Bayview Avenue, Map 35, Parcel 38 SE 77-974 (Continued from 1/21/04).  
         Alfred Pickard represented the Donald’s.  He stated he met with Don Lewis on site to establish a protocol sensitive to the Diamond-Back terrapin and that the existing the fence will have ½ moons cut in the bottom to allow the turtles to come through.  He stated that renourishment will consist of  between 50 and 100 cubic yards of clean sand trucked in at the Donald’s entrance.  There is a peat bank so he will be careful not to place the sand next to it.  Eight (8) feet of grass will be left behind the fence.  Emily Beebe requested he give 24 hours notice before work begins (1 working day).  Dottie Dolan Moved to approve AOOC; Seconded by Ginie Page; Passed 4-0.

Cyndi Moe Moved to adjourn the meeting at 6:55; Seconded by Paul Banner; Passed 4-0.
